Article 1 – Introduction

These general conditions are concluded between:

the Rocyne brand, e-commerce site, owned by the company Rocyne, represented by Cynthia Robert, SIREN identifier 890113251, whose head office is 16, rue Louis Pasteur 92100 Boulogne -Billancourt (France) hereinafter Rocyne.
And on the other hand,
people wishing to make a purchase via the website www.rocyne.com, hereinafter referred to as the “user” or “the customer”.

The customer acknowledges having read and accepted these general conditions of sale before placing the order.
These General Conditions of Sale are subject to change at any time and without notice.

Article 2 – Purpose:

These conditions aim to define the terms of sale between Rocyne and the user, from the order to the services, including payment and delivery.
They regulate all the steps necessary for placing the order and ensure the monitoring of this order between the contracting parties.

Article 3 – Order:

Validation of the order and electronic signature (law of March 13, 2000 on electronic signatures) constitute acceptance of the general conditions of sale.
Unless proven otherwise, the data recorded by Rocyne constitutes proof of all transactions made on the site www. rocyne.com between the company and its customers.

The contractual information will give rise to written confirmation at the latest at the time of delivery, to the customer at the email address that the latter will have communicated.

Before confirming their order, it is essential for the customer to check the spelling of their first and last name as well as their exact address with the city and postal code.

Rocyne cannot be held responsible for these elements essential to the successful delivery of your order. Any order constitutes acceptance of the prices and descriptions of the products available for sale.

Rocyne reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

Article 4 - Availability of products:
Rocyne undertakes to honor orders within the limits of available product stocks. If the product is not available, Rocyne undertakes to inform the user as soon as possible.
Rocyne cannot be held responsible for the unavailability of one or more items.

Article 5 – Price:

The prices of our products are indicated in euros, all taxes included.
All orders regardless of their origin are payable in euros.
Rocyne reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of order registration.

Article 6 – Payment:

The products remain the property of Rocyne until payment has been received in full.
The customer has the choice of paying for their purchases online when ordering: by Bank Card (credit card, Visa, Euro-card, Mastercard, Amex) or by Paypal.

In the event of sold out or unavailable products, the customer will be informed as soon as possible in order to be able to modify their order, with their agreement and according to their wishes.
Rocyne implements all means to ensure the confidentiality and security of data transmitted on the web.

As such, the website uses a secure payment module (PayPal) through an exchange of encrypted data (SSL protocol with 128-bit encryption) and at no time Berthie does not keep the banking information of its customers.


Article 7 – Delivery – deadlines, shipping and packaging costs:

Deliveries - deadlines:
The items are delivered to the delivery address indicated when ordering. The dispatch of the order will be confirmed to the customer on the day of departure by e-mail provided that the customer has correctly communicated his e-mail address. In order to optimize delivery, it is advisable to indicate the most precise address possible where your order can be received during working hours (home, work, business).
Rocyne guarantees the proper delivery of products.

Delivery times are usual average times and correspond to the shipping processing times announced on the product sheets, to which is added the delivery time.
Products are shipped within 3 to 5 working days, while the delivery time is announced depending on the carrier chosen.
Rocyne cannot be held responsible for the consequences due to a delay in delivery, for whatever reason. This does not entitle the buyer to cancel the sale.
Consequently, no claim for compensation of any nature whatsoever may be claimed by the Rocyne customer.
In the event of apparent defects, the customer benefits from the right of return specified below in article 9.
In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.
Shipping and packaging costs:
Postage and packaging costs will be the responsibility of Rocyne.

Article 8 – Withdrawal period:

The withdrawal period granted to the customer on the purchase of goods, in accordance with article L 121 16 of the Consumer Code, is 14 clear days from the date of receipt of the order. During this period, the customer can return, without penalty, the product(s) that do not suit them.
The customer may exchange the product(s) ordered or request a refund.

Returns will only be accepted for complete items in new condition, in their original packaging and with their purchase order for identification.
Items damaged or soiled by the customer will not be taken back.

Article 9 - Product conformity:

The customer can exchange products that are apparently defective or do not correspond to their order. In this case, he must make the request by email, within 7 working days following delivery and return the product.
The product will then be exchanged.
In the case of a product exchange, the shipping costs of the replacement product will not be invoiced to the customer and the shipping costs incurred by the latter will be reimbursed on the basis of the invoiced price.
Returns will only be accepted for complete items in new condition, in their original packaging with their purchase order for identification.
Items damaged or soiled by the customer will not be taken back.
Any complaint made outside this deadline cannot be accepted.

Article 10 - Intellectual properties:

Rocyne has, for all stages of access to the site, the ordering process, delivery, or subsequent services, only an obligation of means.
All elements of the site www. rocyne.com whether visual or audio, are protected by copyright, trademarks or patents. They are the exclusive property of Rocyne.
Any total or partial reproduction of the site www.rocyne.com is strictly prohibited.
Photographs and texts illustrating the products do not enter into the contractual scope. If errors are introduced, Rocyne cannot be held responsible under any circumstances.

Article 11 – Liability:

The products offered comply with current French legislation and the standards applicable in France. Rocyne cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered.
Rocyne 's responsibility cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a breakdown in service, an external intrusion, or the presence of computer viruses, or any event qualified as force majeure beyond its control, for the following reasons and without this list being exhaustive: flood, fire, storm, strike, riot, accidents, etc., in accordance with case law.
Likewise, it is not responsible for the content of websites to which hypertext links may refer from its own site.
Any link, even tacitly authorized, must be removed upon simple request from Rocyne .


Article 12 – Personal data:

The provision of personal information collected for the purposes of distance selling is mandatory, this information being necessary for the processing and delivery of orders, the establishment of invoices and warranty contracts.
In accordance with the “Informatique et Libertés” law, the processing of personal information relating to customers has been declared to the Commission Nationale de l’Informatique et des Libertés (CNIL) under registration number: 1214248. The customer has, under article 34 of the law of January 6, 1978, a right of access, modification, rectification and deletion of data concerning him.
Rocyne undertakes to ensure that they are never communicated to third parties.

Article 13 – Applicable law and jurisdiction:

These conditions are subject to French law.
Rocyne undertakes to respect all the provisions of the Distance Selling Consumer Code.
Jurisdiction in the event of a dispute and in the absence of an amicable agreement between the parties will be given to the courts of the defendant's domicile.
